1. Giriş

Bu Gizlilik Politikası ("Politika"), HTS — Hasar Tespit Sistemi ("Sistem", "Platform") üzerinden işlenen kişisel verilerin, 6698 sayılı Kişisel Verilerin Korunması Kanunu ("KVKK") ve ilgili mevzuat uyarınca hangi kapsamda toplandığını, işlendiğini, saklandığını ve korunduğunu açıklar. Sistem, Zercode tarafından geliştirilmekte ve işletilmektedir. Sisteme erişerek veya Sistemi kullanarak bu Politikada belirtilen esasları kabul etmiş sayılırsınız.

2. Veri Sorumlusu

KVKK kapsamında kişisel verilerinizin veri sorumlusu Zercode'dur. Politikaya ilişkin her türlü talep ve başvurunuzu info@zercode.com adresine iletebilirsiniz.

3. İşlenen Kişisel Veriler

Sistem, sunulan hizmetin niteliği gereği aşağıdaki veri kategorilerini işleyebilir:

• Kimlik ve iletişim verileri: ad-soyad, kullanıcı adı, T.C. kimlik/vergi numarası, telefon, e-posta, unvan/rol.
• Dosya ve hasar verileri: hasar dosyası kayıtları, taraf bilgileri, evrak/belge içerikleri, ödeme ve alacak bilgileri, dilekçe ve yazışmalar.
• İşlem güvenliği verileri: oturum kayıtları, IP adresi, erişim ve işlem logları, tarih/saat bilgisi.
• Kullanım verileri: Sistem üzerinde gerçekleştirilen işlemler, yetki ve rol hareketleri.

Verilerin türü, kullanıcının rolüne ve Sistem içindeki yetkisine göre değişebilir.

4. İşleme Amaçları ve Hukuki Sebepler

Kişisel veriler, KVKK md. 5 ve md. 6'da öngörülen hukuki sebeplere dayanılarak şu amaçlarla işlenir: hasar tespit ve dosya takip hizmetlerinin yürütülmesi; kullanıcı kimliğinin doğrulanması ve yetkilendirme; yasal yükümlülüklerin yerine getirilmesi ve ilgili kurumlara raporlama; Sistem güvenliğinin sağlanması ve kötüye kullanımın önlenmesi; sözleşmenin kurulması ve ifası.

5. Verilerin Aktarılması

Kişisel veriler, yalnızca yukarıdaki amaçlarla sınırlı olmak, KVKK md. 8 ve md. 9'a uygun davranmak ve gerekli teknik/idari tedbirler alınmak kaydıyla; yetkili kamu kurum ve kuruluşlarına, iş ortaklarına ve hizmet sağlayıcılara aktarılabilir. Veriler, hukuki bir sebep olmaksızın üçüncü taraflarla paylaşılmaz ve ticari amaçla satılmaz.

6. Saklama Süreleri

Kişisel veriler, işleme amacının gerektirdiği süre boyunca ve ilgili mevzuatta öngörülen zamanaşımı ve saklama süreleri saklı kalmak kaydıyla muhafaza edilir. Sürelerin dolması hâlinde veriler silinir, yok edilir veya anonim hâle getirilir.

7. Veri Güvenliği

Zercode, kişisel verilerin hukuka aykırı erişime, kayba ve değişikliğe karşı korunması için KVKK md. 12 kapsamında gerekli teknik ve idari tedbirleri alır (erişim yetkilendirmesi, oturum güvenliği, günlük kayıtları, şifreleme ve ağ güvenliği tedbirleri dâhil).

8. Otomatik Erişim, Toplu Veri Çekme ve Yapay Zekâ Kullanımı — Yasaklı Faaliyetler

Sisteme ve Sistem üzerindeki hiçbir veriye; Zercode'un açık ve yazılı izni olmaksızın, otomatik, programatik veya toplu yöntemlerle erişilmesi, veri çekilmesi veya veri toplanması kesinlikle yasaktır. Bu yasak, aşağıdakiler dâhil ancak bunlarla sınırlı olmamak üzere her türlü yöntemi kapsar:

• Web kazıma (scraping/crawling), otomatik gezinme, ekran kazıma, headless tarayıcı veya bot kullanımı;
• Sistemin API'lerine veya uç noktalarına izinsiz, otomatik ya da toplu (bulk) erişim;
• Yapay zekâ (AI/LLM) araçları, ajanları veya otomasyonları ile Sistemden veri toplanması, indekslenmesi, kopyalanması veya model eğitimi/analizi amacıyla veri çıkarılması;
• Verilerin toplu olarak dışa aktarılması, çoğaltılması veya bir veri tabanı/derlem oluşturacak şekilde biriktirilmesi.

KVKK bağlamında: Sistemdeki kişisel verilerin toplu olarak çekilmesi veya işlenmesi, ayrı bir kişisel veri işleme faaliyeti oluşturur ve KVKK md. 5–6 uyarınca geçerli bir hukuki sebep ile veri sorumlusunun (Zercode) izni gerektirir. Bu izin olmaksızın yapılan her türlü otomatik/toplu veri çekimi hukuka aykırıdır ve ilgili kişilerin haklarının ihlali sonucunu doğurur.

İzin şartı: Otomatik veya toplu veri erişimi ancak Zercode ile imzalanmış yazılı bir sözleşme ya da Zercode'un önceden vereceği açık yazılı izinle mümkündür. Böyle bir izin verilmediği sürece Sistemdeki veriler yalnızca yetkili kullanıcı tarafından, arayüz üzerinden ve olağan kullanım amacına uygun biçimde erişilebilir niteliktedir.

Teknik tedbir hakkı: Zercode, bu yasağın uygulanması için hız sınırlama (rate limiting), IP engelleme, güvenlik duvarı (firewall) kuralları, bot tespiti ve erişim kısıtlama dâhil her türlü teknik ve idari tedbiri önceden bildirimde bulunmaksızın uygulama hakkını saklı tutar.

Sorumluluk: Bu bölümün ihlali; erişimin derhal engellenmesini gerektirebileceği gibi, KVKK, 5237 sayılı Türk Ceza Kanunu'nun bilişim sistemlerine ilişkin hükümleri, 5846 sayılı Fikir ve Sanat Eserleri Kanunu kapsamındaki veri tabanı hakları ve haksız rekabete ilişkin mevzuat uyarınca hukuki ve cezai sorumluluk doğurur. Zercode, doğan zararlara ilişkin tüm yasal başvuru haklarını saklı tutar.

9. İlgili Kişinin Hakları (KVKK md. 11)

Kişisel veri sahibi olarak; verilerinizin işlenip işlenmediğini öğrenme, işlenmişse bilgi talep etme, işleme amacını öğrenme, aktarıldığı üçüncü kişileri bilme, eksik/yanlış işlenmişse düzeltilmesini isteme, silinmesini veya yok edilmesini isteme, bu işlemlerin aktarıldığı kişilere bildirilmesini isteme, münhasıran otomatik analiz sonucu aleyhinize çıkan sonuca itiraz etme ve zararın giderilmesini talep etme haklarına sahipsiniz. Başvurularınızı info@zercode.com adresine iletebilirsiniz; talepler KVKK md. 13 uyarınca en geç 30 gün içinde sonuçlandırılır.

10. Çerezler

Sistem, oturum yönetimi ve güvenlik amacıyla zorunlu çerezler kullanabilir.

11. Değişiklikler

Zercode, bu Politikayı zaman zaman güncelleyebilir. Güncel sürüm Sistem üzerinden yayımlandığı anda yürürlüğe girer; önemli değişikliklerde kullanıcılar uygun yöntemlerle bilgilendirilir.

1. Introduction

This Privacy Policy (the "Policy") explains how personal data processed through HTS — Damage Assessment System (the "System", "Platform") is collected, processed, stored and protected in accordance with the Turkish Personal Data Protection Law No. 6698 ("KVKK") and related legislation. The System is developed and operated by Zercode (the "Company"). By accessing or using the System, you are deemed to have accepted the principles set out in this Policy.

2. Data Controller

Under the KVKK, the data controller of your personal data is Zercode. You may direct any requests regarding this Policy to info@zercode.com.

3. Personal Data Processed

Given the nature of the service, the System may process the following categories of data:

• Identity and contact data: full name, username, national ID/tax number, phone, e-mail, title/role.
• Case and damage data: damage case records, party information, document contents, payment and receivable information, petitions and correspondence.
• Transaction security data: session records, IP address, access and activity logs, timestamps.
• Usage data: actions performed within the System, authorization and role activities.

The type of data may vary depending on the user's role and permissions within the System.

4. Purposes and Legal Grounds of Processing

Personal data is processed based on the legal grounds set out in Articles 5 and 6 of the KVKK, for the following purposes: providing damage assessment and case-tracking services; verifying user identity and managing authorization; fulfilling legal obligations and reporting to relevant authorities; ensuring System security and preventing misuse; establishing and performing the contract.

5. Transfer of Data

Personal data may be transferred to authorized public institutions, business partners and service providers, solely for the purposes stated above, in compliance with Articles 8 and 9 of the KVKK and subject to the necessary technical and administrative measures. Data is not shared with third parties without a legal basis and is never sold for commercial purposes.

6. Retention Periods

Personal data is retained for as long as required by the purpose of processing and for the statutory limitation and retention periods stipulated by applicable legislation. Upon expiry, data is deleted, destroyed or anonymized.

7. Data Security

Zercode takes the necessary technical and administrative measures under Article 12 of the KVKK to protect personal data against unlawful access, loss and alteration (including access authorization, session security, logging, encryption and network security measures).

8. Automated Access, Bulk Data Extraction and Use of Artificial Intelligence — Prohibited Activities

Accessing the System or any data within it, and extracting or collecting data by automated, programmatic or bulk methods without Zercode's express written consent, is strictly prohibited. This prohibition covers all methods, including but not limited to:

• Web scraping/crawling, automated browsing, screen scraping, use of headless browsers or bots;
• Unauthorized, automated or bulk access to the System's APIs or endpoints;
• Collecting, indexing, copying or extracting data from the System using artificial intelligence (AI/LLM) tools, agents or automation, including for model training or analysis;
• Bulk export, reproduction or accumulation of data in a manner that forms a database/corpus.

In the context of the KVKK: Bulk extraction or processing of personal data within the System constitutes a separate personal data processing activity and, under Articles 5–6 of the KVKK, requires a valid legal ground and the consent of the data controller (Zercode). Any automated or bulk data extraction performed without such consent is unlawful and results in the violation of data subjects' rights.

Consent requirement: Automated or bulk data access is only possible under a written agreement signed with Zercode or with Zercode's prior express written consent. Unless such consent is granted, data within the System may only be accessed by the authorized user, through the interface, and for ordinary, intended use.

Right to apply technical measures: Zercode reserves the right to apply any technical and administrative measures — including rate limiting, IP blocking, firewall rules, bot detection and access restrictions — without prior notice, to enforce this prohibition.

Liability: Violation of this section may result in immediate blocking of access and gives rise to civil and criminal liability under the KVKK, the provisions of the Turkish Criminal Code No. 5237 concerning information systems, database rights under the Law on Intellectual and Artistic Works No. 5846, and unfair competition legislation. Zercode reserves all legal remedies for any resulting damages.

9. Rights of the Data Subject (KVKK Art. 11)

As a data subject, you have the right to: learn whether your data is processed; request information if it has been processed; learn the purpose of processing; know the third parties to whom data is transferred; request correction of incomplete or inaccurate data; request deletion or destruction; request that such actions be notified to third parties; object to any adverse outcome resulting from automated analysis; and claim compensation for damages. You may submit your requests to info@zercode.com; requests are concluded within 30 days at the latest, pursuant to Article 13 of the KVKK.

10. Cookies

The System may use strictly necessary cookies for session management and security purposes.

11. Changes

Zercode may update this Policy from time to time. The current version takes effect upon publication through the System; users are informed by appropriate means of any material changes.
